These Terms of Use and Service Agreement (“Agreement”) govern your use of Switch Mobile’s wireless services, website, applications, referral program, and related products (collectively, the “Services”).
By purchasing, activating, accessing, or using Switch Services, you agree to be bound by this Agreement.
If you do not agree, do not use the Services.
1. Definitions
“Switch,” “we,” “us,” or “our” refers to Switch Mobile and its affiliates.
“You” or “Customer” refers to the individual or entity using the Services.
“Service” refers to prepaid wireless service, data access, voice, messaging, and related features.
“Device” refers to any phone, tablet, or hardware used with Switch.
“Billing Cycle” refers to the recurring monthly service period.
2. Nature of Service
Switch provides prepaid, month-to-month wireless service operating on a nationwide third-party network.
Switch does not own the underlying network infrastructure.
Coverage, speeds, and service availability depend on:
- Location
- Device compatibility
- Network congestion
- Environmental factors
- Third-party network conditions
Switch does not guarantee uninterrupted or error-free service.
3. Plans & Pricing
Current plans include:
- Pay As You Go — $25 per month
- Unlimited — $50 per month
All plans are prepaid and automatically renew each Billing Cycle unless canceled prior to renewal.
Switch reserves the right to:
- Modify pricing
- Modify features
- Introduce new plans
- Discontinue plans
Notice will be provided where required by law.
4. Taxes & Regulatory Fees
Advertised prices may not include:
- Federal, state, or local taxes
- Regulatory recovery fees
- Government-imposed surcharges
You are responsible for all applicable taxes and government assessments associated with your Service.
5. Payment Authorization
By activating Service, you authorize Switch to charge your selected payment method for recurring monthly service.
Failure of payment may result in:
- Suspension
- Termination
- Loss of referral earnings
- Number release
Chargebacks or payment disputes may result in account suspension.
6. No Contracts; Cancellation
Switch Service is month-to-month.
You may cancel at any time prior to your next Billing Cycle.
No refunds are provided for partial months after activation.
If canceled, your number may be released and may not be recoverable.
7. Activation & Number Porting
You are responsible for providing accurate porting information.
Switch is not responsible for:
- Incorrect account numbers
- Incorrect transfer PINs
- Delays caused by previous carriers
- Loss of service during transfer
Do not cancel your prior carrier before port completion.
Porting failures may require reactivation fees or reprocessing.
8. Network Management & Fair Use
Switch may implement network management practices to preserve network integrity.
Unlimited plans may experience reduced speeds during congestion.
Service is intended for personal, non-commercial use.
Prohibited activities include:
- Reselling service
- Automated high-volume data usage
- Server hosting
- Industrial IoT deployment
- Abuse of tethering
Switch reserves the right to throttle, suspend, or terminate accounts for abusive usage.
9. Device Requirements
Devices must:
- Be unlocked
- Be compatible
- Not be blacklisted
- Not interfere with network operations
Switch is not responsible for issues arising from incompatible or modified devices.
Devices purchased from Switch may be subject to an unlock policy.
10. Referral & Earnings Program
Switch offers a recurring referral program paying $4 per active line per month.
Referral eligibility requires:
- Valid, active accounts
- Good standing
- Compliance with the Acceptable Use Policy
Switch reserves the right to:
- Reverse fraudulent referral credits
- Audit referral activity
- Suspend accounts for manipulation
- Modify or terminate the referral program at any time
Referral earnings are not guaranteed and may change.
11. Suspension & Termination
Switch may suspend or terminate Service without notice if:
- Fraud is suspected
- Payment fails
- Acceptable Use violations occur
- Illegal activity is detected
- Network integrity is threatened
Switch may block devices reported lost or stolen.
Termination does not relieve you of unpaid charges.
12. Emergency Services (E911)
Emergency services (911) are supported; however:
- Location accuracy depends on device capability
- Service availability depends on network coverage
- Indoor or rural coverage may affect performance
Switch is not responsible for emergency service interruptions caused by third-party network failures.
13. International Services
International calling and roaming are subject to:
- Additional fees
- Coverage limitations
- Regulatory restrictions
Switch may limit or suspend international features due to fraud detection or abnormal usage patterns.
14. Indemnification
You agree to indemnify and hold harmless Switch, its affiliates, officers, employees, and partners from any claims arising from:
- Your misuse of Service
- Violation of this Agreement
- Illegal activity
- Device misuse
15. Limitation of Liability
To the maximum extent permitted by law, Switch shall not be liable for:
- Indirect damages
- Lost profits
- Data loss
- Service interruptions
- Third-party network failures
Switch’s total liability shall not exceed the amount paid by you for the prior month of Service.
16. Arbitration & Dispute Resolution
Any dispute shall be resolved through binding individual arbitration.
You waive the right to:
- Jury trial
- Class actions
- Collective proceedings
Arbitration shall be conducted under applicable federal arbitration law.
You may opt out of arbitration within 30 days of activation by submitting written notice to Legal@SwitchMobile.com.
17. Intellectual Property
All website content, trademarks, logos, and branding are property of Switch.
You may not reproduce, distribute, or modify content without written consent.
18. Force Majeure
Switch is not liable for delays or failures caused by events beyond reasonable control, including:
- Natural disasters
- Network outages
- Government actions
- Third-party provider failures
19. Privacy
Use of Service is subject to our Privacy Policy.
By using Switch, you consent to data collection and processing as described therein.
20. Modifications
Switch may update this Agreement at any time.
Continued use of Service constitutes acceptance of updated Terms.
The most current version will be posted on this page.
21. Governing Law
This Agreement shall be governed by the laws of the State of [Insert State], without regard to conflict of law principles.
